TUGMAATREëLS EN TOEPASSING VAN DISSIPLINêRE STELSEL Werskwyse van ouers om probleme aan te spreek Indien u as ouer merk dat u kind ‘n probleem tov ‘n leerarea ervaar, word u aangeraai om die volgende stappe te volg: Stap 1  Kontak u kind se voogonderwyser/es per brief / per telefoon of maak ‘n afspraak. Stap 2  Indien die probleem nie opgelos is nie, kontak die vakonderwyser/es. Stap 3  As daar enige verdere probleme is, kontak die Departementshoof of  Adjunkhoofde. Stap 4  Indien u nog nie tevrede is nie, kontak die hoof • Kategorie 1 oortredings  Hierdie kategorie sluit onder andere die volgende in: 1. Huiswerk nie gedoen nie 2. Boeke en Toetse by die huis / Toetse nie geteken 3. Onderbreek klasdissipline 4. Daag laat op vir klas 5. Skryf skoolwerk af 6. Leuens 7. Treiter maats 8. Tree ongehoorsaam op in ry / ontwrig dissipline in saal/klaskamer ens. 9. Vloektaal / Tekens 10. Disrespekvolle optrede teenoor onderwysers / leiers 11. Verlaat die klas sonder toestemming 12. Bemors die klaskamer en terrein 13. Skooldrag en voorkoms nie volgens voorskrifte 14. In besit van gevaarlike voorwerpe (Bv messe, klappers, speelgoedgewere ens.) Hantering / optrede ten opsigte van kategorie een oortredings ortredings • Vir elke kategorie 1 oortreding ontvang die leerling ‘n geel brief huistoe, met die oortreding daarop aangedui, wat die volgende dag ,   geteken deur die ouers, terug moet kom na die register onderwyser toe. • Nadat vyf kategorie een oortredings in totaal teenoor ‘n leerder se naam aangeteken is, word daar in oorlegpleging met die Adjunk-hoof,   aan die leerder se ouers ‘n waarskuwingsbrief (Vorm B) gegee. • Wanneer ‘n leerder ses kategorie een oortredings begaan het, sal hy/sy onderwerp word aan detensie. Die ouers sal ‘n brief (Vorm C)   ontvang om hulle in kennis te stel van die detensie. • Kategorie een oortredings verval slegs aan die einde van die 1ste kwartaal,  indien slegs 4 oortredings ingeskryf is en word nie   gekanselleer aan die einde van  kwartaal 2 en 3 nie. • Kategorie 2 oortredings  Hierdie kategorie sluit onder andere die volgende in: 1. Wangedrag op bus tydens skooluitstappies 2. Bakleiery (Bv Vuisgeveg / Bytery) 3. Swak gedrag in die openbaar wanneer buite die skool. 8 4. Swak gedrag tydens skoolaangeleenthede 5. Beskadig maats en skool se eiendom 6. Selfoongebruik tydens skoolure. 7. Betreding van skoolterrein buite lesure sonder toestemming. 8. Terugpraat met onderwysers.   Hantering / optrede ten opsigte van kategorie 2 oortredings • Vir elke kategorie 2 oortreding ontvang die leerling ‘n geel brief huistoe, met die oortreding daarop aangedui, wat deur die ouers geteken   moet word en teruggestuur moet word na die skool. • Dit dien as waarskuwingsbrief. • Nadat 3 kategorie 2 oortredings teen ‘n leerder se naam aangeteken is, word die leerder se ouers per brief in kennis gestel   dat hy/sy detensie moet sit. • Kategorie 3 oortredings  Hierdie kategorie sluit onder andere die volgende in: 1. Saakbeskadiging/inbraak/vandalisme 2. Besit/gebruik van gevaarlike wapen (bv ‘n mes). 3. Diefstal 4. Drank en dwelmmisbruik / rook 5. Ernstige ontwrigting van skoolroetine 6. Oneerlikheid tydens eksamen / toetse 7. Voorvalle van rassehaat 8. Versuim 2 maal om aan te meld vir detensie. 9. Seksuele teistering en wandade / Pornografiese materiaal 10. Stokkiesdraai/Verlaat skoolterrein sonder toestemming   Hantering / optrede ten opsigte van kategorie 3 oortredings • Nadat een kategorie 3 oortreding teenoor die leerder se naam aangeteken is, word die aangeleentheid direk na die Dissiplinêre Komitee   van die Beheerliggaam verwys. • Na deeglike ondersoek, word ‘n verhoor met die ouers en kind gehou en die kind word dien ooreenkomstig volgens wetlike   voorskrifte gestraf. • Die Dissiplinêre Komitee kan dan volgens die wet ‘n kind vir 7 dae skors of ‘n aanbeveling na die Departement van Onderwys doen   vir verdere tugstappe / permanente skorsing. TOEPASSSING VAN TUG   Kategorie 1 en 2 oortredings  • Detensie   1. Die leerders wat 5 oortredings begaan het, ontvang ‘n waarskuwingsbrief (Vorm B) Indien ‘n leerder 6 oortredings begaan het,       word ‘n brief (Vorm C) aan sy ouers gestuur (nie later as 7 dae voor datum van detensieklas nie) om aan te dui dat hy/sy       detensie moet sit.   2. Detensie sal plaasvind op Vrydae direk na skool (13:15 tot 17:00).   3. Aktiwiteite vir detensie sal vooraf beplan en streng toegepas word. Ouers is self verantwoordelik vir die afhaal van leerlinge by       die skool aan die einde van  die detensieklas.   4. Leerlinge wat afwesig is of weens begrafnisreëlings nie teenwoordig kan wees nie, moet die daaropvolgende detensieklas       bywoon. Die Adjunk-hoof moet egter vooraf gekontak word en dit sal slegs in uiterste gevalle toegelaat word.   5. Leerlinge wat ‘n tweede keer detensie moet sit of uitermatige dissiplinêre probleme lewer, moet saam met hul ouers voor die        Dissiplinêre Komitee van die Beheerliggaam verskyn. Hierdie komitee kan dan volgens die wet ‘n kind vir 7 dae skors of ‘n       aanbeveling na die Departement van Onderwys doen vir verdere tugstappe. Kategorie 3 oortredings  ‘n Dissiplinêre Komitee bestaande uit twee lede van die Beheerliggaam, waarvan 1 die Voorsitter sal wees, en die twee Adjunkhoofde  sal die dissiplinêre verhoor hanteer.  Addisionele lede met die nodige kennis van bepaalde gebeurtenisse kan gekoöpteer word.  Leerders word vergesel deur sy / haar ouers tydens die verhoor.  Indien die ouers nie die verhoor kan bywoon nie, gaan die verhoor voort met die kind.  Leerders kan teen die uitspraak van die Dissiplinêre Komitee appélleer by die Hoof / Onderwys Departement nadat uitspraak gelewer is.  Geen lid van die Dissiplinêre Komitee mag op die Appélraad dien nie.   SKORSING EN UITSETTING   Behoudens die bepalings van die Skolewet en die toepaslike Provinsiale wet, kan die Beheerliggaam na ‘n regverdige verhoor,  ‘n leerder skors van bywoning van die skool  onder die volgende omstandighede:  i. as ‘n korrektiewe maatreël vir ‘n tydperk wat nie een week te bowe gaan nie;    of ii. in afwagting van ‘n beslissing deur die Departementshoof van die Limpopo Departement van Onderwys of die leerder uit die skool    gesit moet word. Behoudens enige toepaslike provinsiale wet, mag ‘n leerder by ‘n openbare skool uit die skool gesit word onder die volgende omstandighede.    i.  deur die Departementshoof van die Limpopo Departement van Onderwys, en  ii. indien hy of sy na ‘n regverdige verhoor skuldig bevind is aan ernstige wangedrag.    Die Lid van die Uitvoerende Raad belas met Onderwys van Limpopo Provinsie bepaal, by kennisgewing in die Provinsiale Koerant : i.  die gedrag van ‘n leerder by ‘n openbare skool wat as ernstige wangedrag beskou word. ii. dissiplinêre prosedures wat in sodanige gevalle gevolg moet word; iii. bepalings van ‘n behoorlike regsproses om die belange van die leerder en  enige ander party wat by die dissiplinêre handeling     betrokke is, te beskerm.  ‘n Leerder (of ouer van die leerder) wat uit ‘n openbare skool gesit is, kan teen die beslissing van die Departementshoof appél aanteken  by die Lid van die Uitvoerende Raad belas met onderwys in Limpopo Provinsie. Alle akademiese werk wat tydens die tydperk van skorsing agterweë raak moet die leerling self inhaal. Dit is nie die skool of enige personeellid se verantwoordelikheid om toe te sien dat agterstallige werk ingehaal of nagesien word nie.   ONTNEMING VAN VOORREGTE • Kategorie 1 & 2 oortredings  ‘n Leerling wat hom/haar herhaaldelik skuldig maak aan kategorie 1 en kategorie 2 oortredings sal die volgende voorregte ontneem word: i.   Enige leerling wat vir die 2de keer aangemeld word vir detensie sal die voorreg ontneem word om enige Opvoedkundige- of      Sport-uitstappies mee te maak. Dit sluit die volgende in : Enige toer of uitstappie wat deur die skool gereël word vir Gr 1 – 7,      Gr 6-leierontwikkelingskamp, Gr 7 afskeid, ens. ii.  Geen aktiwiteite wat deur die skool as ontspanning aangebied word, mag bygewoon word nie. ( Bv. Kaskardag, Waterkaskenades,      Pretloop, ens.) iii. ‘n Leerling wat die 2de keer aangemeld word vir detensie sal ook nie in aanmerking kom vir enige Meriete toekennings nie en sal die      voorreg ontneem word om enige toekenning op die verhoog tydens die Toekenningsfunksie te ontvang. So ‘n leerling kan nie in      aanmerking kom vir enige van die top toekennings wat tydens so ‘n aand gemaak word nie.   iv. ‘n Leerling wat vir die 2de keer aangemeld word vir detensie sal ook die voorreg ontneem word om in aanmerking te kom om ‘n      Leier aan Laerskool Thabazimbi te word. So ‘n leerling se naam sal nie op enige stemlys verskyn nie. • Kategorie 3 oortredings i. Enige leerling wat ‘n kategorie 3 oortreding begaan en voor die dissiplinêre komitee van die skool skuldig bevind word sal al die voorregte    soos hierbo vermeld ontneem word. Elke leerling begin aan die begin van die jaar met ‘n skoon rekord en geel briewe is nie oordraagbaar van een jaar na ‘n volgende jaar nie. Daar sal egter rekord gehou word van alle oortredings wat deur ‘n leerling gedurende sy/haar skoolloopbaan aan Laerskool Thabazimbi begaan is. PUNISHMENT MEASURES AND THE APPLICATION THEREOF   Handling of offences regarding homework • Should a learner have repeated offences, the teachers will reprimand him/her. • The parents will be contacted if the situation doesn’t improve. • Thereafter the offences will be recorded in the disciplinary code. Method to be followed by parents in addressing problems: Should you as parent find that your child is experiencing a problem in a certain learning area, you are advised to follow these steps: Step 1: Contact you child’s class teacher in writing / telephonic  or make an appointment to see him/her. Step 2: Should the problem persist, contact the relevant subject teacher. Step 3: If there are any further problems, contact the Head of Department or Deputy Principal. Step 4: Should all these steps fail, contact the school principal.   Category 1 offences This category includes the following offences: 1.   Homework not done 2.   Books and Tests at home / Tests not signed 3.   Disrupting class discipline 4.   Late for class 5.   Copying school work 6.   Lies 7.   Teasing 8.   Misbehaving in rows / Disrupting discipline in the hall / classrooms 9.   Swearing / obscene signs 10. Disrespectful towards teachers and leaders 11. Leaving class without permission 12. Littering in class and on school premises 13. School uniform and appearance not according to the rules 14. In possession of dangerous objects like pocket knives, crackers, toy guns, etc.  Management / actions in terms of category 1 offences • For each category 1 offence the learner will receive a yellow letter, to inform the parents about the offence. This letter must be signed   by the parents and sent back to the register teacher the following day. • Once five Category 1 offences have been recorded against a learner’s name, and after consultation with the Deputy Principal, the   parents will receive a warning letter (Form B). • Once six Category 1 offences have been recorded, the learner will have to attend detention class (Form C will inform the   parents of the detention class). • If only 4 Category 1 offences were recorded at the end of the first term, those offences will expire (only at the end of the first term).   No offences will be cancelled at the end of the second and third terms. Category 2 offences This category includes the following offences: 1. Misbehaviour on bus during school excursions. 2. Fighting (e.g. hitting and biting) 3. Bad behaviour in public outside school grounds. 4. Bad behaviour at school functions / sports meetings. 5. Damaging the property of school and friends 6. Use of cell phone during lesson hours 7. Trespassing on school grounds outside lesson hours without permission. 8. Back chatting teachers   Management / actions in terms of category 2 offences • Once a Category 2 offence has been recorded against a learner’s name the learner will receive a yellow letter to inform the parents   of the offences. This letter must be signed by the parents and sent back to the register teacher the following day. • If a third offence is recorded against the learner’s name, the parents will be informed of their child’s detention. Category 3 offences   This category includes the following offences: 1. Vandalism / breaking in / stealing 2. Possession of dangerous weapons (e.g. knife) 3. Theft 4. Alcohol and drug abuse / Smoking 5. Serious disruption of school routine 6. Dishonesty during tests/examination 7. Incidents of racial hatred 8. Failure to report for detention class (2 times) 7. Sexual harassment and misconduct / Possession of pornographic material 8. Truancy (including “bus” pupils) / Leaving school grounds without permission Management / actions in terms of category three offences • Once one Category 3 offence has been recorded against a learner’s name, the issue is referred directly to the • Disciplinary Committee of the Governing Body. • After a thorough investigation, the child (with his/her parents) is interviewed and he/she will be punished according to legal regulations. ENFORSEMENT OF PUNISHMENT    Category 1 and 2 offences  • Detention   1. The parents of learners with five offences will receive a warning letter (Form B), informing them of the offences.     Once a learner has six offences, his/her parents will be notified in writing (Form C) of their child’s detention class (not later than     seven days prior to the detention date).   2. Detention will take place on a Friday, directly after school (13:15 - 17:00).   3. Activities for this period will be planned ahead of time and strictly adhered to. Parents are personally responsible for collecting their       child from the school at detention   4. Learners that are absent with permission, or have funeral arrangements will attend the following detention class.       In such case the parents must contact the Deputy-principal in advance to inform him of the reasons.      This will only be allowed in serious cases.   5.. A learner who has to sit detention for a second time or who is causing serious disciplinary problems, must appear      (with his/her parents) before the Disciplinary Committee of the School Governing Body.      According to the law, this committee has the authority to expel the learner for a period of 7 days, or to make a commendation to     the Department of Education for further disciplinary action Category 3 offences A Disciplinary Committee consisting of 2 members of the Governing Body, the two deputy principals and a Chairperson (who has knowledge of legal matters) will hear the complaints against learners with category 3-offences or serious disciplinary problems. Learners are accompanied by their parents during the hearing. If the parents are not able to attend the hearing, it will continue without them.   Learners may appeal against the verdict of the Disciplinary Committee through the Principal/Department of Education SUSPENSION AND EXPULSION   In keeping with the School Law and the applicable Provincial Law, the Governing Body has the right to suspend a learner from attending school once a fair hearing has taken place: i.  as a corrective measure for a period of no longer than a week; ii. in waiting for a decision by the Head of Department of the Limpopo Department of Education, as to whether or not the learner    is going to be expelled.   According to any appropriate Provincial Law, a learner may be asked to leave the school under the following circumstances:  i.  by the Head of Department of the Limpopo Department of Education ii. if he or she has been found guilty of serious misbehaviour during a fair hearing The Member of the Executive Council responsible for Education in the Limpopo Province determines the following by notification in the Provincial Newspaper: i.   what is deemed as serious misbehaviour by a learner at a public school ii.  disciplinary procedures to be followed in case of the above iii. determination of a thorough legal process which protects the interests of  the learner as well as any other party involved in the disciplinary A learner who has been expelled from a public school or his/her parents have the right to appeal against the decision of the Head of Department. The appeal may be directed to the Member of the Executive Council responsible for education in the Limpopo Province. It is the learner’s own responsibility to catch up school work that has been lost during the period of suspension. The school and the teachers have no responsibility towards a suspended child for any school work during the time of suspension, or to mark such work. DEPRIVING OF PRIVILEGES Category 1 & 2 offences The following privileges will be deprived from learners with category 1 and 2 offences: i.  If a learner must report for detention class for a second time, he/she will be deprived the privilege to take part in any Educational excursions.     This will include the following: Any tour, excursion or Sport event arranged by the school for Gr 1 – 7, Gr 6 leadership camp, Gr 7 farewell ii.  Such a learner will not be allowed to attend any recreational activities organized by  the school. (E.g. Go-carts, Water Fun fare, etc.) iii. Such a learner will not be taken into account for any Merit awards and will not  have the privilege to receive any award during the     Award Ceremony at the end of  the year. Such a learner will not qualify for any of the top awards (for example  Athlete of the Year)     during such an event. iv. A learner who had to sit detention for a second time, will also not be taken into account when choosing prefects for the next year.     Such a learner’s name won’t appear on any of the voting lists. Category 3 offences i. A learner who has been convicted by the Disciplinary Committee for any category 3 offence, will be deprived of all the above-mentioned privileges. At the beginning of the year, each learner will start with a clean record and yellow letters will not be forwarded from one year to another. Record will however be kept of all offences during the time that the learner is enrolled at Laerskool Thabazimbi.
